BY PURCHASING A TICKET TO AN EVENT, YOU FORFEIT IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

PLEASE READ CAREFULLY!  PARTICIPANTS MUST BE 18 OR OLDER.

DISCLAIMER CLAUSE

TREND45 LLC and their agents, officials, officers, directors, employees, volunteers, contractors or representatives (hereinafter refer to as the “RELEASEES”), are not responsible for any death, injury, loss or damage of any kind suffered by any person while participating in TREND45 Events, and all related activities, which might be caused by the negligence or carelessness of the RELEASEES.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors and organizers of the TREND45 Events in which I may participate, and it will govern my actions and responsibilities at said activity or event.

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS TREND45 EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the RELEASEES, from dangerous or defective equipment or property owned, maintained, leased or controlled by them, or because of their possible liability without fault.

In consideration of application and permitting me to participate in TREND45 Events program and all related activities, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, harassment, or actions of any kind which may hereafter occur to me including my traveling to and from this Event, the following entities or persons: the homeowner(s) and the aforementioned RELEASEES including the organizers of the event and/or their directors, officers, employees, volunteers, representatives, and agents, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph, from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

DESCRIPTION OF RISKS

I acknowledge that I am aware of the possible RISKS, DANGERS AND HAZARDS associated with TREND45 Events program and all related activities including THE POSSIBLE RISK OF SEVERE OR FATAL INJURY TO MYSELF OR OTHERS.

These risks include, but are not limited to

● Risks associated with travel to and from all venues including transport by public or private motor vehicle which could include but are not limited to an accident resulting in severe physical injuries or death;

● Intoxication and/or alcohol poisoning from any alcohol I consume during TREND45 Events and all related activities, whether voluntarily or through coercion resulting in illness, injury or death;In consideration of application and permitting me to participate in TREND45 Events program and all related activities, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

● Food-related illness resulting from any meal arranged for me by TREND45 organizers;

● Muscular injuries and soft tissue injuries, broken bones, bruises, scrapes, cuts, sprains, dislocation, head, facial, eye and/or dental injuries which might result from participation in TREND45 Events;
‍
● Injuries resulting from falling or being knocked down or steep steps where a fall may cause injury or death;
‍
● Injuries resulting from rough terrain, failure to see an obstacle, failure to negotiate a turn, etc.;
‍
● Injuries resulting from walking on a hill, slipping and/or falling;
‍
● Injuries resulting from malfunctioning of equipment or misuse of equipment whether owned, designed or operated by myself or any of the RELEASEES;
‍
● Changes in weather or temperatures which may result in hypothermia, frostbite, windburn, sunburn, colds or flu;
‍
● Death, injuries or illness resulting from failure to follow directions from those in charge of the program and all related activities;
‍
● Other risks associated with being a spectator of or being present at a crowded, outdoor or indoor venue.

MEDICAL/HEALTH & TRAVEL INSURANCE

1. I AM SOLELY RESPONSIBLE to select and purchase adequate medical/health insurance. The RELEASEES will provide NO medical/health insurance. In the event of a medical/health problem, the RELEASEES accept no responsibility for any costs associated with a medical/health problem, nor will they pay for any medical/health expenses that may be incurred by the participant.

2. I AM SOLELY RESPONSIBLE to select and purchase adequate travel insurance. The RELEASEES will provide NO travel insurance. The travel insurance should provide coverage against theft, personal accident, personal liability, repatriation and cancellation of tickets among other coverages. The RELEASEES accept NO responsibility for any costs associated with these types of claims, nor will they pay for any expenses that may be incurred by the participant relating to these areas.

3. I agree to advise the organizers of the TREND45 Event, prior to the start of the activity, of any existing medical conditions or injury.

4. I freely accept and assume all responsibility to provide myself with medical/health and travel insurance coverage.

INDEMNIFICATION AND RELEASE OF LIABILITY

In consideration of application and permitting me to participate in TREND45 Events program and all related activities, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

1. I ASSUME AND ACCEPT ALL RISKS, including, but not limited to the DESCRIPTION OF RISKS, above.

2. I AM SOLELY RESPONSIBLE FOR ANY INJURY, LOSS OR DAMAGE which I might sustain,

3. I HOLD HARMLESS AND INDEMNIFY the RELEASEES from any and all liability for any damage to the personal property of, or personal injury to, any third party,

4. I HOLD HARMLESS, INDEMNIFY AND RELEASE THE RELEASEES, from liability for any and all claims, demands, actions and costs,#1-4 – whether arising out of, associated with or related to out my participation in TREND45 Events and all related activities, even though such risks, injury, loss, damage. claims, demands, actions and costs may be been caused by the negligence of The RELEASEES.

PHOTOGRAPHY RELEASE

I UNDERSTAND while participating in this Event, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event organizers, producers, sponsors, and assigns. Any photography taken at the event will be owned by TREND45 LLC and can be used in any way, including but not limited to publication in TREND45 Magazine, social media and websites.

ALCOHOL CONSUMPTION AGE

I acknowledge that the drinking age is 21 years of age and I will NOT consume alcohol at the event if I am under the stated drinking age. I promise to abide by all laws of the state and that the homeowner(s) and organizers of the event and their directors, officers, volunteers, representatives, and agents are NOT responsible for death, disability, personal injury, property damage, property theft, or actions of any kind.

ACKNOWLEDGEMENT

I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, AND UNDERSTOOD I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. This AGREEMENT is to be binding upon myself, my heirs, executors, administrators and representatives.
